Introduction

The Australian Consumer Law that amended the TPA has provided major solutions to business issues that immerge between the corporations and consumers as well as other stakeholders. The law attempts to guide the judgments made so as to ensure fairness to all parties. The case study is an example of such interaction whose interpretations would require intervention by the legal system. All the conclusions involved in the process starting with the primary judge to the full court and finally to the High court will be presented.

Three problems of misleading cited by ACCC against TPG
  • The headline of the TPGs advert was not the same as the terms and conditions attached to the offer that were less displayed
  • The advert was not in accordance to section 1c of article 53 as there was failure of prominent display of individual prices for the services offered in a package form by TPG.
  • The attractive price displayed was deceptive because there were further prices hidden in the less displayed terms of offer.
  • There were further requirements or obligations that were to be met before acquisition of the offer.
